VentOCR Terms of Use

1. Acceptance of Terms

By accessing or using VentOCR ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Service.

2. Nature of the Service

VentOCR is a research-oriented software platform designed for experimental and educational analysis of medical waveform data.

The Service:

  • is not a medical device
  • is not approved by any regulatory authority
  • is not intended for clinical diagnosis or treatment

3. Eligibility

The Service may be used by any individual. You agree to provide accurate registration information and maintain the confidentiality of your account credentials.

You are solely responsible for all activities conducted under your account.

4. User Responsibilities

You agree that:

  1. You will not share your account with others.
  2. You will immediately report any unauthorized use.
  3. You will not create multiple accounts for abusive or unintended purposes.
  4. You will comply with all applicable laws and regulations.

VentOCR reserves the right to suspend or delete accounts that violate these Terms.

5. Data Upload and Content Restrictions

5.1 Permitted Content

Only video files are permitted for upload.

5.2 Prohibited Content

You must not upload:

  • Personal identifiable information (PII)
  • Patient-identifiable medical data
  • Copyrighted or unauthorized content
  • Illegal or harmful material
  • Malware or malicious files

5.3 Anonymization Requirement

You are solely responsible for ensuring that all uploaded data is fully anonymized. This includes:

  • visual identifiers
  • metadata
  • embedded audio

5.4 Responsibility Disclaimer

VentOCR assumes no responsibility whatsoever for any data leakage, including but not limited to audio-based disclosure.

6. Medical Use Restrictions

  1. The Service must not be used for direct clinical decision-making.
  2. Any medical interpretation is the sole responsibility of the user.
  3. The Service is intended strictly for research and educational purposes.

You agree that:

  • VentOCR results are not clinically validated
  • Use in real-world patient care is at your own risk

7. AI and Analysis Disclaimer

  • No guarantee of accuracy, completeness, or reliability
  • Results may vary depending on environment (GPU, model version, etc.)
  • Outputs may contain errors
VentOCR developers bear no liability for any consequences arising from use of results.

8. Intellectual Property

8.1 User Data

All uploaded data remains the property of the user. However:

  • VentOCR does not guarantee storage integrity
  • Users must maintain their own backups

8.2 System and Software

All rights related to VentOCR software, including algorithms and modules, are owned by the developers. You may not:

  • reverse engineer (except where explicitly allowed)
  • copy or redistribute core components
  • misuse the system for competitive purposes

9. Data Retention and Deletion

  • Data may be deleted after 30 days from last login
  • VentOCR is not responsible for data loss
  • No guarantee of backup or recovery

Upon service termination:

  • Users will be notified via registered email
  • Users must download necessary data within the specified period

10. System Use Restrictions

You agree not to:

  • overload servers
  • perform unauthorized API access
  • scrape data
  • attempt unauthorized access
  • use automation tools beyond permitted scope

Violations may result in:

  • account suspension
  • reporting to relevant authorities

11. Security and Monitoring

VentOCR logs system activity. In cases of suspected abuse:

  • logs may be reviewed
  • authorities or affiliated institutions may be notified

12. Citation Requirement

All users must cite VentOCR in any academic output:

Failure to do so constitutes a violation of these Terms.

13. Authorship Policy

Co-authorship is not automatically granted.

Authorship is determined based on the guidelines of the International Committee of Medical Journal Editors. Use of VentOCR alone does not qualify for authorship.

14. Service Plans and Conditions

Service features, including:

  • storage limits
  • queue priority
  • technical support
  • data usage rights

may vary depending on the selected plan. Details are defined separately on the Plans page.

15. Limitation of Liability

To the fullest extent permitted by law, VentOCR developers shall not be liable for any damages, including but not limited to:
  • medical decisions or outcomes
  • data loss
  • system errors
  • service interruptions
  • indirect or consequential damages
All risks are borne solely by the user.

16. Indemnification

You agree to indemnify and hold harmless VentOCR developers from any claims arising from:

  • misuse of the Service
  • violation of laws or regulations
  • unauthorized data handling

17. Service Modification and Termination

VentOCR may:

  • modify features without notice
  • suspend or terminate access
  • discontinue the Service

18. Governing Law

These Terms shall be governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the courts in Japan.

19. Amendments

VentOCR may update these Terms at any time. Continued use of the Service constitutes acceptance of revised Terms.
